SAGASEAL TERMS OF SERVICE

Effective Date: October 18, 2026

Last Updated: October 24, 2026

Welcome to SagaSeal.com. Please read these Terms of Service carefully before using the services offered by Ostrel Software LLC, a Washington limited liability company doing business as SagaSeal ("SagaSeal," "we," "us," or "our"). These Terms of Service set forth the terms and conditions of our relationship and for your ("you," "user," "customer") use of the SagaSeal.com website (the "Site"), associated applications, and the services, features, content, telephone interview systems, and applications offered by SagaSeal (collectively, the "Services").

For purposes of these Terms, "Affiliate" means any entity that directly or indirectly controls, is controlled by, or is under common control with Ostrel Software LLC, where "control" means ownership of more than fifty percent (50%) of the voting or economic interests of an entity, or the power to direct its management and policies.

KEY DEFINITIONS

  • "Story Material" means the life stories, interview answers, call recordings, Original Recordings, transcripts, photographs, uploaded documents, family contributions, voice samples, creative briefs, blueprint content, and any other material provided to SagaSeal by you, a Recipient, or a Contributor for the purpose of creating a book.
  • "Work" means the manuscript, book, audiobook, and related output files that the Services compose from Story Material, including print-ready PDF, EPUB, DOCX, and MP3 audiobook files, and any printed and bound copies.
  • "Buyer" means the person who purchases the Services, including a person who purchases a gift tier for another person.
  • "Recipient" means the person whose story is told and who participates in the interviews. For a self-purchase, the Buyer and the Recipient are the same person. For a gift purchase, they are different people.
  • "Original Recordings" means the audio recordings, and the video recordings where the Recipient has chosen to turn the camera on, that the Services make of the Recipient while the Recipient answers interview questions in the web interview (Talk), together with the playback copies made from them. Editing the text of an answer never changes its Original Recording.
  • "Chapter Code" means the small printed code at the start of a chapter of a printed book that, when scanned with a phone, plays the Original Recordings of the answers that went into that chapter.
  • "Story Keeper" means the family member who holds the Story Keeper role for a project in the family room, as assigned or handed over through the Services.
  • "Contributor" means a family member or friend who submits written memories or other material about the Recipient through a tokenized contribution link, without creating an account.

ACCEPTANCE OF TERMS

YOU UNDERSTAND THAT BY ACCESSING OR USING THE SITE OR SERVICES, YOU ARE AGREEING TO COMPLY WITH AND BE BOUND BY THE TERMS AND CONDITIONS CONTAINED HEREIN ("TERMS OF SERVICE" OR "AGREEMENT"), WHICH ALSO INCORPORATES SAGASEAL'S PRIVACY POLICY. YOU ACKNOWLEDGE AND AGREE THAT, BY ACCESSING OR USING THE SITE OR SERVICES, OR BY DOWNLOADING OR POSTING ANY CONTENT FROM OR ON THE SITE AND/OR THROUGH THE SERVICES, YOU ARE INDICATING THAT YOU HAVE READ, AND THAT YOU UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS, WHETHER OR NOT YOU HAVE REGISTERED WITH THE SITE AND/OR SERVICES. IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU HAVE NO RIGHT TO ACCESS OR USE THE SITE AND/OR SERVICES. IF YOU ACCEPT OR AGREE TO THESE TERMS ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT AND WARRANT THAT YOU HAVE THE AUTHORITY TO BIND THAT COMPANY OR OTHER LEGAL ENTITY TO THESE TERMS AND, IN SUCH EVENT, "YOU" AND "YOUR" WILL REFER AND APPLY TO THAT COMPANY OR OTHER LEGAL ENTITY, AND ITS SUCCESSORS AND ASSIGNORS.

A Recipient who accepts a gift invitation and participates in the interviews, and a Contributor who submits material through a contribution link, each agree to these Terms to the extent of their participation, even if they did not make a purchase and did not create an account.

BINDING ARBITRATION

ANY CLAIM, DISPUTE OR CONTROVERSY OF WHATEVER NATURE ARISING OUT OF OR RELATING TO THESE TERMS OF SERVICE SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION IN ACCORDANCE WITH THE PROCESS DESCRIBED IN THE SECTION TITLED "ARBITRATION AND DISPUTE RESOLUTION" BELOW. PLEASE READ THE SECTION TITLED "ARBITRATION AND DISPUTE RESOLUTION" CAREFULLY.

If you are a consumer habitually resident in the European Union, binding arbitration, the class action and jury waiver, and the King County jurisdiction clause do not apply to you: see the section titled "Consumers in the European Union (Including Hungary)". The same is true if you are a consumer living in another country of the European Economic Area, the United Kingdom, Switzerland, Australia, New Zealand, or Canada, or anywhere else where the law does not allow these clauses to bind a consumer: see the section titled "Consumers Outside the United States".

ABOUT THE SERVICES

What SagaSeal Provides

SagaSeal makes books. Customers, or the people they purchase for, provide life stories and other material through structured interviews and uploads; SagaSeal's AI writes a finished book from that material; and the customer receives the book: on the Memoir, always a printed and bound book, and on the other product lines the files and, on certain tiers, the printed copies described for the tier. The Services include three distinct product lines:

  1. The Memoir (one-time purchase; self-purchase or gift). When you buy the Memoir, you buy one thing: a printed and bound book of the Recipient's life story, in the number of copies and the binding of the edition you choose. The interviews, the writing, and the design are how we make that book. They are not sold separately, and the Memoir cannot be bought without the printed book. The book is made from the Recipient's own words: SagaSeal's AI turns what she tells us in her interviews into the chapters of her book, and the stories and details in it are hers. She reads or listens to her book and approves it before it is printed, and our team may also check it before printing. The book is not written by a human ghostwriter. Anything else an edition includes, such as a digital reading copy, Chapter Codes, or an audiobook on the editions that include one, comes with the book as part of the same single purchase. The interviewer the Recipient speaks with is an AI, not a person, even though it has a name and a voice. The Recipient speaks with that AI interviewer on a screen (the web interview, "Talk", in a browser on a computer, tablet, or phone) and may type instead of speaking where the application allows. Memoir tiers include a printed and bound hardcover book. Every Memoir edition also includes a year of check-ins after the book; like the interviews, they are how we gather the material for a later book and are not sold separately. Some editions also include further printed books, one for each of the Recipient's next birthdays, delivered later as part of the same purchase, as described in "Birthday Volumes." Depending on the tier and the Recipient's country, the Services may also include the Memory Line, a telephone line on which the Recipient may speak memories aloud during the applicable project window, either by calling a number we provide or, where offered, by asking us to call the Recipient; those calls are recorded and transcribed and the material is folded into the book. Availability and duration of the Memory Line vary by tier and country as described at checkout or on the applicable product page. Memoir purchases made under earlier telephone-interview tiers, which are no longer sold, continue to be delivered as described at the time of purchase.

  2. The Book (one-time purchase; sometimes described as the Legacy line). Nonfiction and legacy books for professionals and entrepreneurs, created through a self-serve creation experience that includes book setup, an editable creative blueprint the AI proposes and you refine (including an assistant that proposes blueprint changes for you to apply), optional style tools, a chapter outline, and AI composition of the manuscript chapter by chapter. Optional add-ons may include a scheduled editorial consultation call and, on certain tiers, a mailed physical plan of the book (the "Blueprint Proof") that you approve by mail before writing begins. You may upload or paste your own existing material, which is digested into the creation process. Depending on the tier purchased, the Book may also include printed author copies, a listing packet for Amazon KDP, an ISBN, and a listing packet for IngramSpark, as described at checkout and in the section titled "What SagaSeal Does NOT Provide."

  3. The Catalog (monthly subscription). The same creation tooling offered on a subscription basis, with book credits per billing period, for customers who intend to publish the resulting books themselves, typically through third-party platforms such as Amazon Kindle Direct Publishing ("KDP").

The Services also include, depending on product line, tier, and country: telephone features such as the Memory Line and its call-back; voice dictation in the application; recording of the web interview and, with the Recipient's consent, Chapter Codes (see "Web Interview Recordings, Video, and Chapter Codes"); photograph uploads that appear as plates in the PDF and EPUB output; tokenized contribution links through which family and friends may submit written memories (the "Stories From the Family" feature); tokenized reader and preview links; AI text-to-speech audiobook narration; optional custom narration voices created from a voice recording you submit; printing, binding, and shipping of physical books and related physical goods on applicable tiers; and download of output files.

What SagaSeal Does NOT Provide

You understand and agree that:

  1. SagaSeal is not a publisher, literary agent, or publishing platform. We compose, format, and deliver your book to you. We do not publish, list, market, distribute, or sell your book on your behalf, and we do not upload your book to Amazon KDP or any other retail platform. On the Book tiers that include them, we prepare listing packets: the files and listing information that a platform such as Amazon KDP or IngramSpark asks for, so that you can list the book yourself. Preparing a listing packet is not publishing, listing, or distributing your book. If you choose to publish your Work, you do so yourself, through platforms and channels you select, under your own accounts and at your own risk.

  2. SagaSeal does not register copyrights. Under United States law and the law of most countries, copyright in an original work arises automatically upon creation and fixation. SagaSeal does not file, and these Terms do not include, any copyright registration with the United States Copyright Office or any other authority. If you want the additional legal benefits of registration, you are solely responsible for pursuing it.

  3. SagaSeal provides ISBNs only where a tier says so. On The Imprint · Published and The Founding Volume tiers of the Book, SagaSeal provides one International Standard Book Number for one print edition of the Work. That ISBN is drawn from a block purchased by SagaSeal, so ISBN agency records (such as those maintained by Bowker) may identify SagaSeal as the publisher of record, and a publishing platform may require the publisher or imprint name you enter to match those records exactly. Except as stated in this paragraph, we do not assign, purchase, or register International Standard Book Numbers. If your chosen publishing platform requires or offers an ISBN for any other edition or format (for example, KDP offers a free ISBN for print books), obtaining it is solely your responsibility.

  4. SagaSeal does not file or clear trademarks and does not perform trademark, title, or rights clearance of any kind.

  5. SagaSeal does not provide professional advice. We do not provide legal advice, publishing consulting, financial advice, tax advice, medical advice, therapeutic or counseling services, genealogical research services, or professional advisory services of any kind. You should consult qualified professionals before making decisions in reliance on any output of the Services.

  6. SagaSeal does not guarantee business or publishing outcomes. We make no guarantees regarding sales, revenue, royalties, rankings, reviews, platform acceptance, or the commercial or critical performance of any book. See the section titled "No Earnings Guarantee; Results May Vary."

  7. SagaSeal is not affiliated with Amazon. Amazon, Kindle, and KDP are trademarks of Amazon.com, Inc. or its affiliates. SagaSeal is not affiliated with, endorsed by, or sponsored by Amazon, and we have no control over Amazon's platforms, policies, pricing, or decisions.

  8. SagaSeal is not a lender or credit provider. The Pay in Three installment option described below is a self-financed payment schedule for a single purchase. It is not a loan, does not carry interest or finance charges, and does not involve a credit check or credit reporting.

  9. SagaSeal does not guarantee factual accuracy of AI-composed text. See the section titled "AI-Assisted Composition."

ELIGIBILITY, ACCOUNTS, AND SECURITY

Account Creation and Maintenance

When you create an account with SagaSeal, you agree to the following:

  1. Accurate Information: You will provide accurate, current, and complete information during registration and purchase, and keep your account information updated, including the shipping address used for physical goods.

  2. Age Requirement: You must be at least 18 years of age to create an account, make a purchase, or participate as a Recipient. By using the Services, you represent and warrant that you are 18 years or older. Contributors under 18 may submit contributions only as described in our Privacy Policy and with the permission of a parent or guardian.

  3. One Account Per Person: You will create only one account for yourself and will not create accounts for others without authorization. A gift purchase creates a separate access path for the Recipient as described below; it does not authorize you to operate the Recipient's account or answer interviews in the Recipient's name.

  4. Account Security: You are responsible for maintaining the confidentiality of your credentials, for all activities that occur under your account, and for notifying us promptly of any unauthorized access.

  5. No False Identity: You will not impersonate any person or entity, including answering an interview while posing as the Recipient, or falsely state or misrepresent your affiliation with any person or entity.

  6. Account Termination by User: You may terminate your account at any time through account settings, subject to completion of any outstanding obligations, including any unpaid Pay in Three installments.

  7. Account Termination by SagaSeal: We reserve the right to suspend or terminate your account at any time, with or without cause or notice, including for violation of these Terms, suspected fraud, or abuse of the Services.

Certain features of the Services are accessed through emailed or printed links and codes rather than passwords, including gift invitation links, magic sign-in links, printed certificate codes, contribution links, family dashboards, and reader or preview links. Anyone who possesses one of these links or codes can use it. You and the Recipient are responsible for safeguarding links and codes sent to you, for forwarding them only to intended people, and for notifying us promptly if a link or code is compromised so that we can disable it where feasible. Information already viewed through a link before it is disabled cannot be retrieved. SagaSeal is not liable for access by a person to whom you or the Recipient forwarded, showed, or otherwise disclosed a link or code.

GIFT PURCHASES: THE THREE-PARTY STRUCTURE

Gift tiers involve three roles with distinct rights. By making or accepting a gift purchase, you acknowledge and agree to the following structure:

The Buyer

  1. The Buyer pays for the purchase and is the customer of record for payment purposes. Refunds, when due, are issued to the Buyer's original payment method as described in the Refund Policy section below.
  2. The Buyer receives the finished Work at the end of the project, after the Recipient has had the opportunity to read it first as described below.
  3. The Buyer's tracking portal shows progress metadata only: for example, that a call happened, its duration, and the current stage of the project. The Buyer does not see the content of the Recipient's answers, recordings, transcripts, or manuscript before the Recipient releases the Work, and SagaSeal will not disclose that content to the Buyer at the Buyer's request.
  4. The Buyer does not consent to recording on the Recipient's behalf and cannot override the Recipient's choices about Original Recordings, video, or Chapter Codes (see "Web Interview Recordings, Video, and Chapter Codes" below).

The Recipient

  1. The Recipient is sovereign over the content of the book. The Recipient answers on their own schedule, may decline to answer any question, and may ask that material be left out.
  2. The Recipient is the first reader. No one, including the Buyer, sees a page of the manuscript until the Recipient indicates it is ready, except as required by law.
  3. The Recipient accepts a gift through an emailed single-use invitation link, a magic sign-in link, or a printed certificate code entered on the Site. By participating, the Recipient agrees to these Terms as they apply to the Recipient's participation, including the recording consent provisions below.

If the Recipient Cannot Finish

If the Recipient starts but cannot finish the interviews, the family may complete the book through the Stories From the Family feature, continuing from what the Recipient already told. In that circumstance the material the Recipient already provided remains part of the project unless the Recipient (or the Recipient's legal representative) directs otherwise.

Gift Purchases Are Not Escrow or Trust Arrangements

A gift purchase is a purchase of Services by the Buyer for the benefit of the Recipient. It does not create a trust, escrow, agency, or fiduciary relationship between SagaSeal and either party.

FAMILY AND FRIEND CONTRIBUTIONS (STORIES FROM THE FAMILY)

  1. How Contributions Work: Contributors submit written memories and related material about the Recipient through a tokenized public link. No account is required. Contributors provide their name and email address along with their contribution.

  2. Contributor License: By submitting a contribution, each Contributor grants Ostrel Software LLC the limited license described in the section titled "Your Content and Your Book" for the purpose of creating the Work, and grants the Buyer and Recipient a perpetual, irrevocable, worldwide, royalty-free license to reproduce, adapt, publish, and distribute the contribution, with the Contributor's name, as part of the Work in all formats. Contributors acknowledge that their name will appear with their contribution in the finished book.

  3. Contributions Are Sealed: Contributions are held sealed from the Recipient until the finished book, so that the book can contain surprises. Contributors should not submit anything they are unwilling to have appear, with attribution, in a book the Recipient and the Recipient's family will read and may further distribute.

  4. Contributor Representations: Each Contributor represents and warrants that their contribution is their own, that it does not knowingly include false statements of fact about any living person, and that it does not infringe any third party's rights.

  5. Editorial Discretion: SagaSeal and the customer may edit, condense, exclude, or decline to include any contribution. Submission of a contribution does not guarantee inclusion in the Work.

  6. No Compensation: Contributions are voluntary and uncompensated.

TELEPHONE CALLS, RECORDING, AND TRANSCRIPTION

The Services include several telephone surfaces: the AI interviewing voice on applicable tiers, human interviewers on applicable tiers, the Memory Line, call-backs and call-ins that resume an interview, and scheduled editorial consultation calls.

ALL INTERVIEW-RELATED CALLS ARE RECORDED AND TRANSCRIBED. You acknowledge and agree to the following:

  1. Consent to Recording: Washington and a number of other states require the consent of all parties to record a conversation. By placing a call to the Services (including the Memory Line), by answering a call from the Services, or by scheduling or participating in an interview or consultation call, you consent to the recording and transcription of that call. A notice of recording is also provided in call flows at or near the start of the call. If you do not consent to recording, do not remain on the call; hang up and contact us at hello@sagaseal.com to discuss alternatives such as the typed interview.

  2. Others on the Line: You agree not to include another person on a recorded call without that person's consent. If another person will be audible on the call (for example, a family member assisting the Recipient), you are responsible for informing them that the call is recorded and obtaining their consent.

  3. AI Interviewer Disclosure: On tiers that include the AI interviewing voice, the interviewer on the call is an automated, AI-driven voice, not a human being. Human interviewers conduct the calls on tiers described as human-interviewer tiers.

  4. Purpose Limitation: Recordings and transcripts of interview-related calls are made for the sole purpose of composing, editing, and producing your book and operating the Services, as further described in our Privacy Policy. We do not sell call recordings and do not use them for third-party advertising.

  5. Telephone Networks: Calls are carried over third-party telephone networks and telephony providers. Standard carrier charges from your own telephone provider may apply to calls you place, depending on your plan; the Memory Line is a toll-free number within the United States and Canada.

  6. Consent to Be Contacted: By providing a telephone number and using call-back, scheduled interview, or consultation features, you consent to receive calls, including calls placed by automated systems and calls using an artificial or prerecorded AI voice, at that number for the purpose of conducting your interviews and operating the Services. These are transactional service calls, not marketing calls. You may withdraw this consent by contacting us, in which case telephone-based features may become unavailable to you.

WEB INTERVIEW RECORDINGS, VIDEO, AND CHAPTER CODES

When the Recipient answers questions in the web interview (Talk), the Services record what the Recipient says. This section applies in addition to the telephone section above.

  1. Audio Recording, With Notice and Consent: Before the Recipient's first session, the Services show a notice that everything the Recipient says in Talk is recorded so that the book keeps the Recipient's own words, and the interviewer asks aloud whether that is all right. The Recipient's answer is recorded with the session. Only the Recipient gives this consent. A Buyer cannot consent on the Recipient's behalf. A visible indicator shows whenever recording is taking place.

  2. Video Is Optional: The Recipient is offered a free choice between "Yes, use my camera" and "Just my voice", with nothing selected in advance. The camera stays off unless the Recipient chooses it. The Recipient may change this choice at any time from the More menu in Talk, and may ask us to delete any video. If the camera is unavailable, the interview continues with audio only.

  3. Other People in the Room: If anyone else is present while the Recipient is recording, they may be heard (and, if the camera is on, seen). The Recipient, and anyone helping the Recipient, is responsible for telling other people in the room that they may be recorded, and for not recording anyone who objects. Do not record other people without their consent.

  4. The Recipient Owns the Original Recordings: As between SagaSeal, the Buyer, and the family, the Original Recordings belong to the Recipient. The Recipient grants the Buyer, and the family members the Recipient's choices allow, a personal, non-exclusive, non-transferable, royalty-free license to listen to, watch, and download a copy of the Original Recordings for private, non-commercial family use. The Recipient (or, after the Recipient's death or incapacity, the person described in item 9) may revoke or narrow this license at any time; revocation stops playback through the Services but cannot recall copies already downloaded. Nobody may sell, publish, or commercially use the Original Recordings, or use them to create a synthetic voice or likeness, without the Recipient's separate written permission.

  5. Chapter Codes Require a Separate Yes: Before a book is printed, the Recipient is asked separately whether each chapter may carry a Chapter Code. Anyone holding a printed book can scan a Chapter Code and hear the Original Recordings for that chapter, and see them where video was recorded. The Recipient may turn Chapter Codes off for any chapter, at any time, including after printing; a code that has been turned off no longer plays anything. The Buyer cannot override the Recipient's choice. Because a printed book can be lent, given, or sold, the Recipient should allow Chapter Codes only for chapters the Recipient is comfortable having heard by anyone who holds the book.

  6. No Recognition, No Training: We do not use Original Recordings for face recognition, voice recognition, voiceprints, or any other identification of a person, and we do not use them, and do not allow our service providers to use them, to train artificial intelligence models. Original Recordings are transcribed and timed by automated speech-to-text systems solely to make the book and to play the right passage for each chapter.

  7. Retention and Deletion: We keep Original Recordings while the Recipient's account exists, or until the Recipient (or the person described in item 9) asks us to delete them, whichever comes first. We delete the recordings we are asked to delete within 30 days of a verified request, and copies in backup systems are overwritten in the ordinary backup cycle after that, as described in our Privacy Policy.

  8. If SagaSeal Stops Offering Recordings: If we ever stop offering playback of Original Recordings, or close the Services, we will give at least 90 days' notice by email to the Recipient's account and, where we have it, the Story Keeper's account, and we will make a full download of the Original Recordings available before playback ends.

  9. After the Recipient's Death or Incapacity: The Recipient may name a successor through the Story Keeper role. After the Recipient's death or incapacity, the Story Keeper (or, if there is none, the Recipient's legal representative, on proof of authority) may manage playback, Chapter Codes, downloads, and deletion of the Original Recordings, within the choices the Recipient made while able to make them.

VOICE SAMPLES AND CUSTOM AUDIOBOOK NARRATION

On applicable tiers or features, you may submit a recording of a voice to create a custom narration voice (a "Voice Clone") used to narrate an audiobook. The following terms apply:

  1. Explicit Consent Required: A Voice Clone will be created only from a voice sample submitted for that purpose with the explicit consent of the person whose voice it is. By submitting a voice sample, you represent and warrant that the voice is your own, or that you have the express, informed consent of the person whose voice it is (or of their legal representative) to create a synthetic narration voice from it for the purposes described here.

  2. Scope Limitation: A Voice Clone is used solely to narrate audiobooks of your own books created through the Services. We do not use a Voice Clone to narrate other customers' books, to create promotional or marketing audio without separate consent, to identify anyone, or for any purpose unrelated to producing your audiobooks. We do not sell, license, or share Voice Clones or voice samples with third parties except with the service providers who process them on our behalf to render your audiobook.

  3. No Impersonation: You may not submit a voice sample of a public figure, a celebrity, or any person who has not consented, and you may not use a Voice Clone to deceive any person about who is speaking.

  4. Retention and Deletion: Voice samples and Voice Clones are retained as described in our Privacy Policy and are deleted upon your verified request, subject to a reasonable period to complete deletion from production and backup systems. Deleting a Voice Clone does not affect audiobook files already rendered and delivered to you.

  5. Biometric-Adjacent Data: Some jurisdictions treat voiceprints and similar data as biometric information subject to specific statutes. We collect and use voice samples only with consent, only for the disclosed purpose, and with the retention and deletion commitments stated in the Privacy Policy. If you are in a jurisdiction with a biometric privacy statute and do not wish this processing to occur, do not submit a voice sample; standard AI narration voices remain available.

AI-ASSISTED COMPOSITION

Nature of AI Composition

You understand and acknowledge that:

  1. AI-Generated Text: Manuscripts, chapter drafts, blueprints, personas, outlines, titles, photo descriptions, audiobook narration, and other content provided through the Services are generated or processed using artificial intelligence, machine learning models, and automated systems, working from the Story Material you and your Contributors provide.

  2. Errors Are Possible: AI-composed text can contain errors, including factual mistakes, misattributed details, invented specifics, chronology errors, misspelled names, mischaracterizations of people or events, and stylistic inconsistencies. AI systems can produce fluent text that is nonetheless wrong.

  3. Not Professional Judgment: AI-generated content is an algorithmic output based on the material provided and statistical models. It is not a professional opinion, a historical record, a verified biography, or a substitute for human judgment.

  4. No Warranty of Accuracy: We do not warrant that AI-composed content is accurate, complete, faithful to the Story Material, free of unintended implications about real people, or suitable for any particular purpose.

  5. Continuous Evolution: Our AI models, prompts, pipelines, and methodologies are continuously updated and improved. Output produced at different times from similar inputs may vary.

  6. The Interviewer Is an AI: The interviewer in the web interview (Talk), and the interviewing voice on any telephone feature that uses one, is an artificial intelligence system, not a human being, even though it has a name and a voice. The questions it asks are generated by AI from what the Recipient has already said.

  7. Review Before Printing Is Not Fact-Checking: The Recipient approves her book before it is printed, and our team may check it for completeness and print quality. Neither of these verifies facts, and our check does not replace your own review described below.

Your Responsibility to Review

You are solely responsible for reviewing the Work, in full, before printing, publishing, distributing, gifting, or otherwise relying on it. This includes verifying names, dates, facts, and characterizations of real people; removing anything you do not want in print; and confirming that the Work does not defame any person, invade any person's privacy, or infringe any third party's rights. Requesting a printed copy, downloading output files, publishing through a third-party platform, or distributing the Work in any form constitutes your acceptance of the content as reviewed by you.

YOUR CONTENT AND YOUR BOOK

You Own Your Material and Your Book

  1. Story Material: As between you and SagaSeal, you retain ownership of all Story Material you provide. Contributors retain ownership of their contributions, subject to the licenses described in these Terms.

  2. The Work: As between you and SagaSeal, the finished Work belongs to you. Subject to payment in full and to the limited rights and licenses described in these Terms, Ostrel Software LLC assigns and agrees to assign to you all right, title, and interest it may hold in the text of the Work composed for you through the Services. We retain no royalty, resale, reprint, or revenue-sharing rights in your Work. You may print, publish, sell, adapt, and license your Work freely.

  3. What Ownership Does Not Include: Your ownership of the Work does not extend to the SagaSeal platform, software, prompts, pipelines, models, templates, designs, typography systems, or other tooling used to create it (see "SagaSeal's Proprietary Rights" below), and does not include any copyright registration or trademark, neither of which SagaSeal provides, or ownership of any ISBN that SagaSeal provides on an applicable tier. You acknowledge that the legal treatment of AI-assisted works, including the scope of copyright protection available for AI-generated text, is an evolving area of law, and SagaSeal makes no warranty regarding the registrability or scope of copyright protection in the Work.

  4. Limited Operational License to SagaSeal: You (and each Recipient and Contributor, as to their material) grant Ostrel Software LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, transcribe, translate, adapt, format, and process Story Material and the Work, including processing with artificial intelligence systems and the service providers identified in our Privacy Policy, solely as needed to operate the Services and produce, print, ship, and deliver your book and related deliverables, to maintain backups, and to comply with law. This license ends when the material is deleted from our systems in accordance with our retention practices, except for material we must retain to comply with law or resolve disputes.

  5. No Advertising or Resale Use of Story Material: We do not sell Story Material and we do not use it for third-party advertising. Any use of Story Material beyond operating the Services (for example, use of an excerpt in marketing) requires your separate, express permission.

Your Representations About Your Material

You represent and warrant that:

  1. You have all rights necessary to provide the Story Material you submit, including any photographs, letters, documents, and third-party material within it;
  2. To your knowledge, the Story Material does not include false statements of fact presented as true about any living person;
  3. You have obtained any consents required to submit photographs or recordings of other people, and to tell the parts of other people's stories included in your material;
  4. Your Story Material and your intended use of the Work do not violate any law or infringe any third party's intellectual property, privacy, or publicity rights.

Stories Involve Real People

Memoirs and legacy books describe real people and real events. You, not SagaSeal, are responsible for what your book says about other people. SagaSeal does not fact-check your book, does not verify the events described, and does not review the Work for defamation, privacy, or publicity issues. If your book will describe living people in ways they may object to, we encourage you to seek advice from a qualified attorney before distributing it.

SagaSeal's Proprietary Rights

  1. Ownership: The Services, including all software, algorithms, artificial intelligence pipelines and prompts, user interfaces, visual designs, typography systems, templates, editorial personas, trademarks, logos, and other materials (collectively, the "SagaSeal Property") are owned by Ostrel Software LLC, its Affiliates, its licensors, or other providers of such material, and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. Nothing in these Terms transfers any right, title, or interest in the SagaSeal Property to you.

  2. Trademarks: SAGASEAL, the SagaSeal seal and logo, and other SagaSeal graphics, logos, product names, and service names are trademarks of Ostrel Software LLC or its Affiliates. You may not use these trademarks without our prior written permission, except to truthfully state that your book was created with SagaSeal.

  3. Limited License: Subject to your compliance with these Terms, SagaSeal grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal or internal business purposes.

  4. Restrictions: You may not copy, modify, or create derivative works of the Services or SagaSeal Property; reverse engineer, decompile, or disassemble the Services; remove, alter, or obscure proprietary notices; or use the Services or SagaSeal Property beyond the scope of the license granted.

PUBLISHING, DISTRIBUTION, AND THIRD-PARTY PLATFORMS

  1. You Publish; We Do Not: If you publish your Work, you do so under your own accounts, in your own name or imprint, and subject to the terms of the platforms you choose. This is so even when you use a listing packet or an ISBN that we provide. You are solely responsible for compliance with the policies of Amazon KDP and any other platform, including content policies, metadata accuracy, AI-content disclosure requirements, and tax and identity requirements.

  2. Format Support: Output files are provided in the formats described on the applicable product pages (currently print-ready PDF, EPUB, DOCX, and MP3 audiobook, plus cover-wrap files and print presets where applicable, and listing packets on the Book tiers that include them). We provide guidance for common workflows such as Send to Kindle, but we do not warrant that any platform will accept any particular file.

  3. Amazon Non-Affiliation: Amazon, Kindle, and KDP are trademarks of Amazon.com, Inc. or its affiliates. SagaSeal is not affiliated with Amazon, and nothing in the Services constitutes a representation that Amazon will accept, list, feature, or continue to list any book.

NO EARNINGS GUARANTEE; RESULTS MAY VARY

This section applies to all users and particularly to Catalog subscribers who intend to sell books:

  1. No Income Claims: SagaSeal makes no representation or guarantee that you will earn any money, recoup your subscription or purchase costs, achieve any level of sales, royalties, rankings, or reviews, or succeed in building a publishing business. Any examples, case studies, or testimonials describe individual experiences and are not typical results and are not promises of your results.
  2. Your Results Depend on You and on Factors Beyond Anyone's Control: Outcomes depend on your topics, quality decisions, pricing, marketing, platform policies, competition, and market conditions, among many other factors.
  3. Not Investment or Business Advice: The Services are a production tool, not a business opportunity, franchise, investment program, or coaching program, and nothing in the Services constitutes financial, investment, or business advice.

PRICING, PAYMENT, AND REFUND POLICY

Pricing

  1. Price at Checkout Governs: Prices for each product line and tier are displayed at checkout at the time of purchase. Pricing is subject to change; the price shown at your checkout governs your purchase.
  2. One-Time Purchases: Memoir and Book (Legacy) tiers are one-time purchases. Optional add-ons (for example, an editorial consultation call) are one-time purchases priced at checkout. Each Birthday Volume ordered on its own is a separate one-time purchase; nothing renews (see "Birthday Volumes").
  3. Currency and Taxes: Prices are shown in the currency of the country you are buying in. Outside the United States, the price shown includes any VAT, GST, or similar tax that we are required to charge on your order, and the total at checkout is the total you pay to us. In the United States, any sales tax we are required to collect is added and shown at checkout before you pay. If import duties, import taxes, or customs fees could be charged on delivery of your order in its destination country, we tell you before you pay. Where we have told you that none will be charged, or where E.10 applies, we reimburse any that a carrier charges you on the books included in your edition.

The Catalog Subscription

  1. Recurring Billing: The Catalog is a monthly subscription. By subscribing, you authorize us and our payment processor to charge your payment method the subscription fee at the start of each billing period until you cancel.
  2. Book Credits: Each billing period includes the number of book credits described for your plan. Unless otherwise stated on the applicable plan page, credits are for use within your subscription, are not redeemable for cash, and expire when your subscription ends.
  3. Cancellation: You may cancel at any time through your account settings or by contacting hello@sagaseal.com. Cancellation takes effect at the end of the current billing period. You retain access, and may use remaining credits, through the end of the period you have paid for.
  4. Subscription Refunds: Except as required by law or as expressly stated at checkout, subscription charges already made are non-refundable, and we do not provide partial-period refunds or credit refunds. Books already composed and files already delivered remain yours after cancellation.
  5. Plan Changes: We may change subscription pricing or plan contents prospectively with notice; changes take effect at your next billing period, and you may cancel before they apply.

Pay in Three (Installment Option)

On select checkouts, we offer Pay in Three, a payment schedule financed by SagaSeal itself:

  1. What It Is: The total purchase price is divided into three installments. The first installment is charged at checkout; the remaining installments are charged to your payment method on the schedule shown at checkout. Pay in Three carries no interest, no fees, and no finance charge; the sum of the installments equals the purchase price.
  2. What It Is Not: Pay in Three is not a loan, credit card, or third-party financing product. There is no credit check and no reporting to credit bureaus. No lending brand is involved.
  3. Authorization: By selecting Pay in Three, you authorize us and our payment processor to charge each remaining installment to your stored payment method on the disclosed schedule, and to retry a failed installment.
  4. Failed Installments: If an installment fails, we will retry the charge. As a deliberate product decision, we do not suspend your access to your project because an installment failed. The unpaid balance remains due and owing. We may contact you to update your payment method, offset unpaid amounts against any refund otherwise due, and pursue collection of amounts that remain unpaid, and we may decline future purchases until the balance is paid.
  5. Refunds on Installment Purchases: If a purchase made with Pay in Three is refunded under the Refund Policy below, or the Buyer withdraws from the contract, we refund the installments actually paid and cancel the remaining installments.

Coupons and Promotional Codes

Promotional codes, including codes granting a discounted or fully discounted start, are subject to the conditions stated with the code, are not redeemable for cash, may be limited to specific products or audiences, and may be revoked in cases of fraud or abuse. A purchase started with a 100 percent discount code remains subject to these Terms.

Refund Policy

The Memoir (all tiers, self-purchase and gift), orders placed on or after October 19, 2026:

In short: the Recipient tries it first. A full refund is available before the Recipient starts, and for seven days after the Recipient's first conversation (in any case until fourteen days after purchase), never later than four months after purchase. After that there are no cash refunds, but the Recipient can always finish early or pause. Once the final proof is approved and the book goes to print, it cannot be refunded, unless it is faulty or arrives damaged. The details below govern.

  1. Definitions: In this Refund Policy:
    • The Recipient "opens the gift" at the moment the gift code is first redeemed, whether through the emailed invitation link or the printed certificate code, as recorded by the Services.
    • The "first conversation" is the first interview session in which the Recipient answers at least one question. In a self-purchase, the Buyer is the Recipient.
    • "Final proof approval" is the Recipient's approval of the final proof of the book for printing.
    • The "four-month cap" is four (4) calendar months after the date of purchase. It is one overall cap: every refund window in items 2 to 4, for a gift and for a self-purchase, closes no later than the four-month cap, whether or not the gift has been opened and whenever the first conversation takes place.
  2. Gift, Before the Recipient Starts: The Buyer may request a full refund at any time before the first conversation, until thirty (30) days after the Recipient opens the gift, and in any case no later than the four-month cap. If the gift is never opened, this window closes at the four-month cap. This window ends at the first conversation.
  3. Self-Purchase, Before You Start: You may request a full refund at any time within thirty (30) days of purchase, as long as your first conversation has not taken place. This window ends at the first conversation.
  4. Seven Days After the First Conversation, and at Least Fourteen Days After Purchase: The Buyer may request a full refund within seven (7) days after the first conversation, no questions asked: no form, no exit interview, and no explanation are required. The seven days run from the first conversation, however many sessions follow it within those seven days. If the Recipient's first conversation happens before payment, the seven (7) days run from payment instead. In any case this window stays open until at least fourteen (14) days after purchase: it closes at the later of the end of those seven days and the end of fourteen (14) days after purchase, and never later than the four-month cap. If the first conversation takes place after the four-month cap, this window does not open.
  5. After That, No Cash Refunds; Finish Early or Pause: Outside the windows in items 2 to 4, the purchase is not refundable in cash, except as required by law. The Recipient is never left without a way forward and may instead:
    • Finish early: we write a shorter book from everything the Recipient has told us so far; or
    • Pause: the Recipient's story waits. Pausing alone never causes a project to be archived or deleted, and the Recipient can resume at any time. This does not limit deletion at the Recipient's own request under our Privacy Policy.
  6. After Final Proof Approval: Once final proof approval is given and the book goes to print, the purchase cannot be refunded, unless the printed book is faulty or arrives damaged (see also "Physical Goods, Printing, and Shipping"), and except as required by law.
  7. Pay in Three: If a refund is due on a Pay in Three purchase, we refund the installments actually paid and cancel the remaining installments. If the Recipient pauses or finishes early, the remaining installments continue on the schedule shown at checkout.
  8. Shared Cost: If the cost of a gift was shared through the Services, each payer is refunded their own share, to the payment method that paid it.
  9. Gift Box Already Shipped: If a gift box has already shipped when a refund is issued, the refund is the purchase price less the price paid for the gift box.
  10. Where Refunds Go: Refunds are issued to the card or other payment method that paid. Refunds are processed manually by our support team and typically settle to your account within five (5) business days of processing.
  11. Who May Request, and How: Only the Buyer may request a refund, by emailing hello@sagaseal.com from the email address associated with the purchase. A request is on time if we receive it inside the applicable window. In a gift, the Recipient cannot request a refund, and the Buyer's request does not need the Recipient's confirmation. If a refund is issued after the Recipient has begun, we will email the Recipient the manuscript in progress as a goodwill gesture, so their words are not lost.
  12. Full Refund, Not Partial: Inside a window in items 2 to 4, the full purchase price is refunded, subject only to items 7 to 9. Outside those windows, the purchase is non-refundable except as required by law or as we may agree in our discretion.
  13. Birthday Volumes: A refund of an edition under items 2 to 4 includes the Birthday Volumes that come with it. What happens when an included or ordered volume cannot be made, and how an ordered volume is cancelled, is described in "Birthday Volumes" and applies in addition to this Refund Policy.

The Memoir, orders placed before October 19, 2026: These orders keep the refund terms they were sold under. The Buyer is entitled to a full refund at any time within ninety (90) days of purchase, returned to the original payment method, with no form, no exit interview, and no explanation required. The window opens at purchase and closes at the end of the ninetieth (90th) day after purchase. Inside the window the full purchase price is refunded, and the refund is not reduced by printing or shipping costs we have already incurred. On a gift, before the Recipient has begun, the Buyer may request the refund without involving the Recipient; after the Recipient has begun, the request must come from or be confirmed by the Recipient, and we will email the Recipient the manuscript in progress as a goodwill gesture. Requests are made by email to hello@sagaseal.com from the email address associated with the purchase.

The Book (all tiers): You are entitled to a full refund of your Book purchase at any time within ninety (90) days of purchase. The window opens at purchase and closes at the end of the ninetieth (90th) day after purchase, and nothing in these Terms shortens it. You request a refund by emailing hello@sagaseal.com from the email address associated with the purchase; refunds typically settle within five (5) business days of processing. Inside the window, the full purchase price is refunded to the original payment method, and the refund is not reduced by printing or shipping costs we have already incurred. Add-on consultation calls are refundable in full if cancelled at least 48 hours before the scheduled call.

The Catalog: Subscription refunds are governed by the subscription terms above.

Your Legal Rights: This Refund Policy does not affect your legal rights as a consumer. If you live outside the United States, see also "Consumers Outside the United States". If you live in the European Union, you also have the right of withdrawal in E.4, which we keep.

General: Refunds are issued to the original payment method. We may deny refund requests that we determine in good faith to be fraudulent or abusive (for example, repeated purchase-refund cycles designed to extract deliverables), but we will not use this paragraph to defeat a good-faith request inside a promised window.

Payment Processing

  1. Third-Party Processor: Payments are processed by Stripe and potentially other third-party payment processors. Card numbers are handled by the processor and are not stored on SagaSeal's systems. You agree to comply with the processor's applicable terms.
  2. Payment Authorization: You authorize SagaSeal and its payment processors to charge your selected payment method for the purchases, subscriptions, installments, and add-ons you select, and any applicable taxes.
  3. Billing Information Accuracy: You agree to provide current, complete, and accurate billing and shipping information and to update it promptly if it changes.
  4. Failed Payments: Except as provided in the Pay in Three section, if a payment fails we may suspend the affected Services until payment is successfully processed.
  5. Chargebacks: If you believe a charge is in error, we ask that you contact us first; initiating a chargeback on a charge that was authorized and consistent with these Terms may result in suspension of the Services pending resolution.

PHYSICAL GOODS, PRINTING, AND SHIPPING

On applicable tiers, the Services include physical goods such as printed and bound books, gift boxes, printed certificates, companion and prompt cards, and the mailed Blueprint Proof. The following terms apply:

  1. Production Times Are Estimates: Printing, binding, and shipping timeframes communicated to you are good-faith estimates, not guarantees. Production of a memoir depends in part on the Recipient's own pace through the interviews.
  2. Shipping and Risk of Loss: We ship to the address you provide. You are responsible for providing an accurate, deliverable address. Risk of loss passes to you upon delivery by the carrier to the address provided. If a shipment is lost or arrives damaged, contact us at hello@sagaseal.com and we will work with you in good faith, including reprinting and reshipping defective or damaged books.
  3. Print Variations: Reasonable variations in color, paper, binding, and trim inherent to printing processes are not defects.
  4. Content in Print Is Your Responsibility: Consistent with the section titled "AI-Assisted Composition," you are responsible for reviewing content before it is printed. A book printed after you requested printing, with content you had the opportunity to review, is not defective by reason of its content.
  5. International Shipping: Where international shipping is offered and we told you before you paid that import charges could apply to your order, you are the importer of record and are responsible for those customs duties, import taxes, and brokerage fees, and for compliance with the import rules of the destination country. Where we told you before you paid that no import charges will apply, or where E.10 applies, we reimburse any such charges a carrier collects from you on the books included in your edition.
  6. Blueprint Proof: On tiers that include a mailed Blueprint Proof, composition is held until we receive your approval of the plan of the book by the stated approval channel. Delays in your approval extend the project timeline accordingly.

HEIRLOOM REPRINTS

This section applies to the Heirloom Edition. It describes its six numbered copies and our promise to reprint them, described on our site as "lifetime reprint access."

  1. Six Copies, Numbered and Signed by the Recipient: The Heirloom Edition includes six (6) copies of the book, which are its Volume I, and Volumes II and III, one (1) hardcover copy each, as described in "Birthday Volumes." The numbering, signing, and reprint promise in this section cover the six copies of Volume I only. After the books ship, we mail the Recipient a separate signing kit with large-print instructions: six bookplates, each with a blank line for the copy number ("Copy No. ___ of 6") and a line for a signature, two spare bookplates, a pen, a "Register of Copies" card, and envelopes for copies kept in other homes (stamped for addresses in the United States). The Recipient writes the number and signs each bookplate by hand. If the Recipient is unable to sign, a family member the Recipient chooses may sign on the Recipient's behalf, marked "for" the Recipient, or a copy may be numbered without a signature. We do not number or sign copies ourselves.
  2. What the Reprint Promise Covers: If a numbered copy is lost, damaged, or worn out, we print and ship a replacement of the same book from the final approved print files. A replacement does not include changes to the text, photographs, or cover. It comes with a new bookplate marked as the replacement for the number it replaces (for example, "Replacement for No. 3"), so a replacement never adds a seventh numbered copy. Extra copies for the family are ordered separately at the prices shown on our site and are not part of the six.
  3. Who May Ask, and How: The Buyer may ask through the gift dashboard or by email to hello@sagaseal.com. The Recipient or the Story Keeper may ask by email to hello@sagaseal.com. For a lost copy, a short statement is enough. For a damaged or worn copy, we may ask for one photo. One request per numbered copy may be open at a time.
  4. Six Free Reprints, Then at Our Cost: The first six (6) replacements for each Heirloom Edition are free, including standard shipping, for the life of the set, with no yearly limit. After that, replacements remain available at our cost: the printer's price for the copy plus postage, with no markup. We tell you the exact amount before anything is printed, and nothing is charged until you agree. Requests we decline, and requests that are cancelled, do not count toward the six. Heirloom Editions purchased before October 20, 2026 have no limit on free replacements.
  5. Shipping: We ship replacements by our printer's standard mail to any country our printer serves, within thirty (30) days of the request (for a replacement at our cost, within thirty (30) days of your agreement to the price), unless we tell you otherwise. Outside the United States, any import charges on a replacement are paid by the person receiving it, unless the law of that country provides otherwise.
  6. What "Lifetime" Means: Lifetime reprint access lasts for the life of the book, not the life of any person. It has no end date, does not end at the Recipient's death, and binds any business that takes over SagaSeal. If our printer stops offering the same binding, we use the closest comparable binding available to us.
  7. If SagaSeal Closes: If we stop offering reprints and no successor takes them over, we will give at least ninety (90) days' notice by email to the Buyer, the Recipient, and the Story Keeper. During that time, you may use any free replacements that remain, and we will make the book's print-ready files available to download, with permission to print them anywhere for personal and family use.
  8. Deletion Ends Reprints: If the Recipient, or the person described in item 9 of "Web Interview Recordings, Video, and Chapter Codes," asks us to delete the book's files, we can no longer reprint the book. We will say so before we delete them.
  9. Your Other Rights: This is a limited promise, included in the price of the Heirloom Edition and not sold separately, and it is given in addition to your rights under law, which it does not limit. A copy that is faulty or arrives damaged is handled under "Physical Goods, Printing, and Shipping" (and, for consumers in the European Union, E.9) and does not count toward the six free replacements. We may decline a request that we determine in good faith to be fraudulent.

BIRTHDAY VOLUMES

This section applies to the Memoir. A "Birthday Volume" is a further book in the Recipient's memoir, made for the Recipient's birthday from the check-ins described below, together with the photos and stories the family adds that year. The first book is Volume I; the next is Volume II, and so on.

  1. A Year of Check-Ins After Every Book: Every Memoir edition, and every Birthday Volume, includes a year of check-ins after the book is delivered: four (4) conversations with our AI interviewer, of about twenty (20) to thirty (30) minutes each, about every three (3) months, on our website, like the first interview. After that year, check-ins pause until the next volume is ordered. While they are paused, the Recipient's stories stay readable in the Services and can be exported, and nothing is deleted because check-ins have paused. This does not limit deletion at the Recipient's own request under our Privacy Policy.
  2. Each Volume Is a Separate One-Time Purchase: As a year of check-ins comes to an end, the next volume, if the edition does not include it, may be ordered. Each volume ordered on its own is a separate one-time purchase, at the price shown when it is ordered (the list price is ninety-nine US dollars, $99; in another currency, the price shown at checkout). Whoever orders a volume is its Buyer for these Terms. Nothing renews and nothing is charged automatically: we charge for a volume only when its Buyer orders and pays for it, and ordering one volume never commits anyone to the next.
  3. Volumes Included in an Edition: The Life includes Volume II. The Heirloom includes Volumes II and III; its Volume I is the six copies described in "Heirloom Reprints." Each included volume is one (1) hardcover copy. Included volumes are part of the edition's price, are not sold separately, and have no cash value: they cannot be exchanged for money, except for the refund described in item 5. Extra copies of any volume may be ordered at the prices shown on our site.
  4. By the Recipient's Birthday: Each volume is made for the Recipient's birthday that falls about a year after the previous book was delivered, and is due to arrive by that birthday. We ask for the Recipient's birthday before the first volume is due. As with the first book, the Recipient reads and approves each volume before it is printed. If a volume will arrive more than thirty (30) days after that birthday, we tell the Buyer as soon as we know, with the new expected date, and the Buyer may then cancel that volume: an ordered volume for a full refund, an included volume for the refund in item 5.
  5. If a Volume Cannot Be Made: If an included or ordered volume cannot be made because the Recipient has passed away or can no longer take part, we ask the Buyer to choose one of two:
    • A memorial volume: a volume made from the Recipient's recordings and from the stories and photos the family has shared; or
    • A refund: fifty US dollars ($50) for each included volume of the Life, sixty-five US dollars ($65) for each included volume of the Heirloom, or the price paid for an ordered volume. Where the edition was bought at another price (for example, in another currency, at a regional price, or with a promotional code), the refund for an included volume is the same share of the price paid for the edition ($50 of $399 for the Life, $65 of $1,497 for the Heirloom). If the Buyer does not answer within thirty (30) days of our asking, we refund. If the edition itself is refunded under the Refund Policy, its included volumes are refunded with it, and a volume ordered for that book that has not been printed is refunded in full.
  6. Cancelling an Ordered Volume: The Buyer may cancel an ordered volume for a full refund at any time until the Recipient approves it for print. Once it is approved and goes to print, it cannot be refunded, unless the printed book is faulty or arrives damaged (see "Physical Goods, Printing, and Shipping").
  7. Where Refunds Go: Refunds under this section go to the payment method that paid, as described in the Refund Policy.
  8. Your Other Rights: These terms are in addition to your rights under law, which they do not limit. If you live outside the United States, see also "Consumers Outside the United States". If you are a consumer in the European Union, see also "Consumers in the European Union (Including Hungary)".

REFERRAL PARTNER PROGRAM

SagaSeal operates a referral partner program under which approved partners earn referral royalties on qualifying referred purchases. The partner program is governed by its own separate terms presented to partners at application and enrollment. Nothing in these Terms of Service creates partner rights or obligations, and partner status does not make anyone an agent, employee, or representative of SagaSeal.

  9. Commercial Misuse: Represent yourself as affiliated with SagaSeal without authorization, or use SagaSeal's name or marks to market your own services without permission.

Consequences of Violation

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account, forfeiture of any paid fees without refund to the extent permitted by law, legal action to recover damages and enforce our rights, and reporting to appropriate law enforcement authorities. Termination for violation does not terminate your payment obligations, including unpaid Pay in Three installments.

THIRD-PARTY SERVICES AND CONTENT

  1. Service Providers: The Services rely on third-party providers, including payment processing (Stripe), telephony (SignalWire), transcription and AI model providers, hosting and infrastructure providers, email delivery providers, address lookup services, analytics providers, and printing and shipping partners. Their processing of personal data is described in our Privacy Policy.

  4. No Liability: SagaSeal is not liable for any loss or damage arising from your use of or reliance on third-party services, subject to the Limitation of Liability section below.

CHANGES TO THE SERVICES AND TERMS

Service Modifications

  1. Right to Modify: SagaSeal reserves the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice to users, provided that we will not use this right to deprive you of paid deliverables for a project already purchased without a remedy consistent with the Refund Policy, and that any discontinuation of Original Recordings playback is subject to the 90-day notice and full download described in "Web Interview Recordings, Video, and Chapter Codes".
  2. Feature Changes: Features, functionality, AI models, editorial pipelines, tier contents, and other aspects of the Services may change over time. We are not obligated to maintain any specific feature or model.
  3. No Liability: SagaSeal is not liable for any modification, suspension, or discontinuation of the Services conducted in good faith for business or technical reasons, subject to the paid-deliverables commitment above.

Terms Updates

  1. Changes to Terms: SagaSeal may update these Terms of Service from time to time. We will notify you of material changes by posting the updated Terms on the Site and updating the "Last Updated" date.
  2. Notice Period: Where legally required, we will provide advance notice of material changes and may require you to affirmatively accept updated Terms before continuing to use the Services.
  3. Continued Use: Your continued use of the Services after Terms are updated constitutes your acceptance of the updated Terms.
  4. Checking for Updates: You are responsible for reviewing these Terms periodically. We recommend checking the "Last Updated" date when you use the Services.

MONITORING AND ENFORCEMENT

Our Rights

SagaSeal reserves the right, but has no obligation, to:

  1. Monitor use of the Services for compliance with these Terms;
  2. Investigate violations of these Terms or applicable laws;
  3. Remove, modify, or disable access to any content that we reasonably believe violates these Terms or applicable law;
  4. Suspend or terminate accounts as described in these Terms;
  5. Cooperate with law enforcement or regulatory authorities pursuant to valid legal process;
  6. Take any other action we reasonably deem necessary to protect our rights, property, and users, or to comply with legal obligations.

No Obligation to Monitor

You acknowledge that SagaSeal has no obligation to monitor, screen, fact-check, or vet Story Material, contributions, or AI-generated content; that SagaSeal does not routinely review manuscripts for accuracy, defamation, or rights issues; that monitoring, if conducted, does not create any duty or liability on SagaSeal's part; and that SagaSeal's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Essential Purpose

YOU ACKNOWLEDGE THAT THE LIMITATIONS IN THIS SECTION ARE AN ESSENTIAL ELEMENT OF THE BARGAIN BETWEEN YOU AND SAGASEAL, AND THAT SAGASEAL WOULD NOT PROVIDE THE SERVICES AT THE CURRENT PRICING WITHOUT THESE LIMITATIONS. THESE LIMITATIONS ALLOCATE THE RISKS BETWEEN THE PARTIES AND FORM THE BASIS OF THE BARGAIN.

Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, and consumers in some jurisdictions (including the European Union, the United Kingdom, Australia, New Zealand, and Canada) have statutory rights that cannot be limited by contract (see "Consumers Outside the United States"). In such jurisdictions, the above limitations apply only to the maximum extent permitted by applicable law, and nothing in these Terms limits any non-waivable statutory rights available to you.

INDEMNIFICATION

Your Indemnity Obligations

You agree to indemnify, defend, and hold harmless Ostrel Software LLC, its parents, subsidiaries, Affiliates, officers, directors, employees, agents, contractors, licensors, and service providers (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, expenses (including reasonable attorneys' fees and costs), judgments, fines, penalties, and other amounts arising out of or relating to:

  1. Your Use: Your access to or use of the Services;
  2. Violations: Your violation of these Terms or any applicable law, regulation, or third-party right;
  3. Story Material: Any Story Material you provide, including any claim that it infringes or violates any third party's rights;
  4. Content About Others: Any claim by any person, including a person described in your book, arising from the contents of your book or its distribution, including defamation, false light, privacy, or publicity claims;
  5. Voice Samples: Any claim arising from a voice sample you submitted, including a claim that the person whose voice it is did not consent;
  6. Consent to Recording: Any claim arising from another person being audible on a recorded call without consent you were responsible for obtaining;
  7. Publishing Activity: Your publication, sale, marketing, or distribution of the Work, including claims arising under the policies of any publishing platform;
  8. Misrepresentations: Any misrepresentation made by you, including impersonating a Recipient or misusing another person's payment method;
  9. Breach: Any breach of your representations, warranties, or obligations under these Terms.

Defense and Settlement

SagaSeal reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree not to settle any such claim without SagaSeal's prior written consent. You will cooperate fully with SagaSeal in the defense of any claim, including providing relevant information and documentation.

ELECTRONIC COMMUNICATIONS AND NOTICES

By using the Services, you consent to receive electronic communications from SagaSeal, including:

  1. Emails regarding your account, purchases, and projects;
  2. Gift invitations, magic sign-in links, and tokenized links you request or that your project generates;
  3. Interview scheduling, call-back, and Memory Line related messages;
  4. Payment receipts, installment notices, and refund notifications;
  5. Notices about changes to Terms, the Privacy Policy, or the Services;
  6. Promotional emails, if you opt in to marketing communications;
  7. Legal notices and disclosures.

Electronic Delivery of Documents

You agree that SagaSeal may provide all agreements, notices, disclosures, and other communications electronically. To receive them you must have internet access, a valid email address that you check regularly, and software capable of viewing HTML email and PDF documents.

Right to Opt Out (With Limitations)

  1. Transactional Emails: You cannot opt out of transactional or service-related emails (account notifications, receipts, installment notices, project and delivery notices, legal notices) while using the Services.
  2. Marketing Emails: You may opt out of promotional emails at any time by using the unsubscribe link in such emails or adjusting your preferences.
  3. Consequence of Withdrawal: If you withdraw consent to all electronic communications while you have an active project, outstanding installments, or pending shipments, you may miss critical notices, which could adversely affect your project.

Updating Contact Information

You must keep your email address, telephone number, and shipping address current and promptly notify us of changes by updating your account or emailing hello@sagaseal.com.

Paper Copies

You may request a paper copy of any electronic communication by contacting hello@sagaseal.com. We may charge a reasonable fee for providing paper copies.

CONSUMERS OUTSIDE THE UNITED STATES

C.1 Scope. This section applies if you are a consumer who lives outside the United States. Where it conflicts with any other part of these Terms, this section prevails. If you live in the European Union, the section titled "Consumers in the European Union (Including Hungary)" also applies to you, and where the two differ, the one more favourable to you prevails.

C.2 Your Statutory Rights Come First. Nothing in these Terms excludes, restricts, or modifies any right or remedy that the law of the country where you live gives you as a consumer and that cannot be excluded by contract. In particular, nothing in these Terms limits:

  • in the European Union and the other countries of the European Economic Area, your rights under the consumer protection law of the country where you live;
  • in the United Kingdom, your statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013;
  • in Australia, the consumer guarantees and your other rights under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010);
  • in New Zealand, your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986;
  • in Canada, your rights under the consumer protection law of your province or territory.

The disclaimers in "Disclaimers and Warranties", the limits in "Limitation of Liability", the indemnity in "Indemnification", and every other part of these Terms apply to you only to the extent that the law of the country where you live allows. If you live in Australia or New Zealand, we do not rely on any part of these Terms to contract out of, or limit, a consumer guarantee.

C.3 Courts and Disputes. If you are a consumer habitually resident in a country of the European Economic Area, the United Kingdom, Switzerland, Australia, New Zealand, or Canada, or in any other country whose law does not allow a consumer to be bound by these clauses, then the sections titled "Binding Arbitration" and "Arbitration and Dispute Resolution" (including the class action and jury waiver) and the King County jurisdiction clause in "Jurisdiction" do not apply to you. You may bring proceedings against us in the courts of the country (in Canada, the province or territory) where you live, including any small claims court or disputes tribunal, or in Washington. These Terms are governed by the laws of the State of Washington, but you keep the protection of the mandatory consumer law of the place where you live.

C.4 A Book Made for One Person. Each book is made to the Recipient's specifications and is clearly personalised. For that reason, the law of many countries gives no statutory right to cancel the purchase of such a book because you have changed your mind (for example, regulation 28(1)(b) of the UK Consumer Contracts Regulations 2013 and Article 16(c) of EU Directive 2011/83/EU). This takes nothing away from our own Refund Policy: its refund windows apply to you wherever you live, on the words set out in "Refund Policy" above. If you live in the European Union, we also give you the fourteen-day right of withdrawal described in E.4, and we keep it.

C.5 Faulty or Damaged Books. If a printed book is faulty, arrives damaged, or is not as described, you have the remedies the law of the country where you live gives you, which may include repair, replacement, a price reduction, or a refund. Our promise to reprint and reship faulty or damaged books, and the Heirloom reprint promise, are given in addition to those rights and do not reduce them.

C.6 Australia. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service. Our promises to reprint faulty or damaged books are given by Ostrel Software LLC, 522 W Riverside Ave, Ste N, Spokane, WA 99201, USA, email hello@sagaseal.com. To claim, email us with your order details and a photo of the fault; we bear the cost of the replacement and of sending it to you. The benefits of these promises are in addition to your other rights and remedies under a law in relation to the goods or services to which they relate.

C.7 Prices. The price shown at checkout is in your local currency and includes any VAT, GST, or similar tax we are required to charge. If import charges could apply to your order, we tell you before you pay (see "Pricing").

CONSUMERS IN THE EUROPEAN UNION (INCLUDING HUNGARY)

E.1 Scope. This section applies if you are a consumer habitually resident in a member state of the European Union. Where it conflicts with any other part of these Terms, this section prevails.

E.2 Who We Are. The Services are provided by Ostrel Software LLC, a Washington (USA) limited liability company doing business as SagaSeal, 522 W Riverside Ave, Ste N, Spokane, WA 99201, USA. Email: hello@sagaseal.com. Website: https://www.sagaseal.com.

E.3 Who the Customer Is. The Buyer is the contracting party and the only person who can withdraw from the contract or request a refund. In a gift, the Recipient benefits from the contract and may report a fault directly to us. A person who shares the cost through the Services is not a party to the contract; their share is refunded to the payment method that paid it.

E.4 Right of Withdrawal.

  • You may withdraw from the contract within fourteen (14) days of its conclusion (the day of purchase), without giving any reason. For physical items sold separately (for example, the gift box or extra copies of a book), the period is fourteen (14) days from the day you, or a person you name other than the carrier, receive them.
  • To withdraw, send us an unequivocal statement (for example, by email to hello@sagaseal.com or by post to the address in E.2), use the model withdrawal form on our withdrawal information page (https://www.sagaseal.com/withdrawal-information), or use our online withdrawal function, "Withdraw from contract" (https://www.sagaseal.com/withdraw). You withdraw in time if you send your statement before the period ends. We acknowledge every withdrawal by email without delay, stating its content and the date and time we received it.
  • We reimburse all payments received from you, including the costs of standard delivery, without undue delay and at the latest within fourteen (14) days of the day we receive your withdrawal, using the same means of payment you used, unless you expressly agree otherwise. You pay no fees for the reimbursement. Installments not yet charged are cancelled.

E.5 Starting Early. At checkout you expressly asked us to begin performing the service before the withdrawal period ends, and you acknowledged the consequences. By law, if you withdraw after performance has begun, you may owe an amount proportionate to what was provided until you withdrew. We do not charge this amount when you withdraw inside the refund windows of our Refund Policy. The right of withdrawal ends once the service has been fully performed, which is when the finished book (and the audiobook, if your edition includes one) has been delivered.

E.6 More Generous, Never Less. The refund windows in our Refund Policy apply in addition to your right of withdrawal and never shorten it.

E.7 Physical Items Sold Separately. You may withdraw from the purchase of a physical item sold separately within fourteen (14) days of receiving it. You bear the direct cost of returning it. We refund its price and the original standard delivery cost. Microphones included with your edition do not need to be returned.

E.8 The Printed Book. Each book is made to the Recipient's specifications and is clearly personalised. Once the final proof is approved and the book goes to print, it cannot be returned or refunded, except under E.9.

E.9 Legal Guarantee. You have the legal guarantee of conformity for the service and for the books and other physical items we deliver. For goods it lasts at least two (2) years from delivery. If something is faulty, you may ask for repair or replacement and, if that is not possible or not done within a reasonable time, a price reduction or the termination of the contract. Nothing in these Terms limits these rights. The legal guarantee information required in Hungary is on our withdrawal information page.

E.10 Delivery and Price. The price shown at checkout is the total price you pay, including any VAT and the delivery of the books included in your edition. We print and ship the book after the final proof is approved and, unless a different time is stated at checkout, ship it within thirty (30) days of that approval. You will not be asked to pay customs duties or import charges on the delivery of the books included in your edition; if a carrier charges you any, we reimburse them.

E.11 Complaints. You can complain by email to hello@sagaseal.com or by post to the address in E.2. We answer in writing within thirty (30) days. If we reject your complaint, we tell you in writing which consumer protection authority and which conciliation body (in Hungary, the conciliation body, békéltető testület, competent for your place of residence) you can turn to.

E.12 Law and Courts. These Terms are governed by the laws of the State of Washington, but you keep the protection of the mandatory provisions of the law of the country where you habitually reside. You may bring proceedings against us in the courts of the country where you live or in Washington; we may bring proceedings against you only in the courts of the country where you live. Binding arbitration, the class action and jury waiver (including the sections titled "Binding Arbitration" and "Arbitration and Dispute Resolution") and the King County jurisdiction clause in "Jurisdiction" do not apply to you.

E.13 Language. If you live in Hungary, the Hungarian version of these Terms, once published, is equally authoritative. If the English and Hungarian versions differ, the meaning more favourable to you prevails.

E.14 Pay in Three. Pay in Three carries no interest and no fees. A refund or a withdrawal cancels every installment not yet charged.

E.15 Heirloom Reprints. The reprint promise described in "Heirloom Reprints" is a commercial guarantee given free of charge by Ostrel Software LLC (address in E.2). It covers the six copies of an Heirloom Edition, on the terms and by the procedure set out in that section (by email to hello@sagaseal.com, or through the gift dashboard). It is given in addition to your legal guarantee under E.9 and does not affect it. We email you its terms on a durable medium (a PDF) when your books ship.

GOVERNING LAW AND JURISDICTION

Applicable Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Washington and the federal laws of the United States, without regard to conflict of law principles. Nothing in these Terms limits any non-waivable statutory rights or protections available to you under the laws of your state or country of residence.

Company Information

Ostrel Software LLC is a limited liability company organized under the laws of the State of Washington, with a business address at 522 W Riverside Ave, Ste N, Spokane, WA 99201.

Jurisdiction

Subject to the arbitration provisions below, you agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of such courts. This paragraph does not apply to consumers habitually resident in the European Union (see "Consumers in the European Union (Including Hungary)") or to the other consumers described in C.3 (see "Consumers Outside the United States").

ARBITRATION AND DISPUTE RESOLUTION

Mandatory Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and SagaSeal agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (collectively, "Disputes") shall be resolved through binding individual arbitration, except as specifically provided below. This section, including the class action and jury waiver, does not apply to the consumers described in E.12 and C.3, who may use the courts where they live.

Exceptions to Arbitration

The following matters are NOT subject to arbitration and may be brought in court:

  1. Intellectual Property Claims: Claims regarding infringement or misappropriation of intellectual property rights (copyright, trademark, patent, trade secret);
  2. Injunctive Relief: Claims seeking temporary restraining orders or preliminary or permanent injunctive or equitable relief;
  3. Small Claims: Claims that qualify for small claims court, provided they remain in such court and are brought only on an individual basis.

Arbitration Procedures

  1. Governing Rules: Arbitration shall be administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules and, if applicable, its Consumer Arbitration Rules (available at www.adr.org).

  2. Starting Arbitration: To begin arbitration, you or SagaSeal must send a written notice of the dispute to the other party, attempting to resolve the matter informally for at least 30 days before initiating formal arbitration proceedings. Notice to SagaSeal shall be sent to hello@sagaseal.com and to Ostrel Software LLC, 522 W Riverside Ave, Ste N, Spokane, WA 99201.

  3. Arbitrator Authority: The arbitrator, not any court or agency, shall have exclusive authority to resolve all disputes, including but not limited to disputes about the interpretation, applicability, enforceability, or formation of these Terms, including the arbitrability of any claim and the scope of this arbitration clause.

  4. Location: Arbitration shall be conducted by videoconference or telephone unless you elect an in-person hearing. If you elect an in-person hearing, it shall take place in the county of your residence or principal place of business, or at another location mutually agreed by the parties.

  5. Individual Basis: Arbitration shall be conducted on an individual basis only. You may not consolidate your arbitration with other arbitrations or bring claims as a representative or member of a class.

  6. Written Decision: The arbitrator shall issue a written decision that includes the essential findings and conclusions on which the decision is based.

  7. Arbitration Fees: AAA filing, administration, and arbitrator fees shall be governed by AAA rules, except that SagaSeal will reimburse those fees for claims totaling less than $10,000 unless the arbitrator determines the claims are frivolous or brought for an improper purpose.

  8. Attorney's Fees: The prevailing party in any arbitration shall be entitled to an award of reasonable attorneys' fees and costs, unless prohibited by applicable law.

  9. Enforcement: Judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action and Jury Waiver

WITH RESPECT TO ALL DISPUTES, REGARDLESS OF WHETHER THEY ARISE IN CONTRACT, TORT, OR OTHERWISE, YOU AND SAGASEAL EXPRESSLY AGREE AND COVENANT:

  1. NO CLASS ACTIONS: ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, OR PRIVATE ATTORNEY GENERAL ACTION.

  2. NO CONSOLIDATION: THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

  3. NO JURY TRIAL: YOU AND SAGASEAL ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY.

  4. NO PUBLIC COURT: YOU AND SAGASEAL ARE EACH WAIVING THE RIGHT TO LITIGATE DISPUTES IN COURT BEFORE A JUDGE OR JURY (EXCEPT AS PROVIDED IN THE "EXCEPTIONS TO ARBITRATION" SECTION).

Opt-Out Right

You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to hello@sagaseal.com within thirty (30) days of first accepting these Terms. Your notice must include your name, email address, account username (if created), and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, you and SagaSeal agree that Disputes will be resolved in the state or federal courts located in King County, Washington, subject to the jurisdiction provisions above.

Severability of Arbitration Provision

If any portion of this arbitration provision is found to be unenforceable, the unenforceable portion shall be severed and the remaining portions shall be enforced to the maximum extent possible. However, if the class action waiver is found to be unenforceable as to a particular claim or category of claims, this entire arbitration provision shall be null and void as to such claim or category of claims only (but the remainder of these Terms shall remain in effect, and arbitration shall remain in effect for other claims).

DATA PRIVACY

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data collection, use, sharing, retention, and protection practices, including how we handle call recordings, transcripts, photographs, voice samples, and the deeply personal content that life stories contain.

GENERAL PROVISIONS

Entire Agreement

These Terms of Service, together with our Privacy Policy, the separate referral partner program terms (for enrolled partners), and any additional terms you agree to when using specific features of the Services or at checkout, constitute the entire agreement between you and SagaSeal regarding the Services and supersede all prior agreements and understandings (whether written or oral).

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect to the maximum extent possible. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the intent of the parties.

Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. SagaSeal's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged in writing by an authorized representative of SagaSeal.

Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without SagaSeal's prior written consent, except that upon delivery the Work and the licenses in it may be transferred as personal property (for example, gifting the finished book). Any other attempted assignment in violation of this provision is void. SagaSeal may assign, transfer, or delegate its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of assets. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.

No Agency

No agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created by these Terms. You are not authorized to make any representation, contract, or commitment on behalf of SagaSeal.

Force Majeure

SagaSeal shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, strikes, labor disputes, shortages of transportation facilities, fuel, energy, labor, or materials, or failures of third-party services (including payment processors, telephony providers, AI model providers, hosting providers, printing partners, shipping carriers, or internet infrastructure).

Survival

The following sections shall survive termination of these Terms or termination of your account: Key Definitions, Your Content and Your Book (including the licenses granted), Family and Friend Contributions (contributor licenses), Telephone Calls, Recording, and Transcription (as to recordings already made), Web Interview Recordings, Video, and Chapter Codes (ownership, license limits, retention, deletion, and notice commitments), Voice Samples and Custom Audiobook Narration (retention and deletion commitments), No Earnings Guarantee, Disclaimers and Warranties, Limitation of Liability, Indemnification, Arbitration and Dispute Resolution, Governing Law and Jurisdiction, and any other provision that by its nature should survive termination.

Section Headings

Section headings in these Terms are for convenience only and have no legal or contractual effect. They do not limit, expand, or otherwise affect the interpretation of the provisions.

Interpretation

As used in these Terms, "including" means "including but not limited to." The use of "or" is not exclusive unless context requires otherwise. The words "herein," "hereof," and "hereunder" refer to these Terms as a whole. References to "writing" or "written" include electronic communications.

Language

These Terms are drafted in English. The Site and Services may be offered in other languages, including Hungarian, and these Terms may be translated for convenience. If there is a discrepancy between the English version and any translation, the English version shall prevail and control to the extent permitted by applicable law. For consumers in Hungary, the section titled "Consumers in the European Union (Including Hungary)" provides otherwise (E.13).

Export Controls

You may not use, export, re-export, or transfer the Services except as authorized by U.S. law, the laws of the jurisdiction in which the Services were obtained, and any applicable export control laws. You represent and warrant that you are not located in a country subject to U.S. embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.

Third-Party Beneficiaries

Except as expressly provided in this Section, these Terms do not confer any rights on any third party. In the United Kingdom, no one other than you and SagaSeal has any right under the Contracts (Rights of Third Parties) Act 1999 to enforce these Terms, except that a Recipient may enforce the parts of these Terms made for the Recipient's benefit. Each of the Indemnified Parties and each Affiliate of Ostrel Software LLC is an intended third-party beneficiary of, and may directly enforce, the sections titled "Disclaimers and Warranties," "Limitation of Liability," "Indemnification," and "Arbitration and Dispute Resolution."
